Introduction to the Terms of Use
Our online store welcomes you and informs you that below you will find the terms and conditions governing your use of this store, as well as all legal consequences arising from your use of the store’s services through this electronic platform.
The use of the store by any person, whether as a consumer of a service or product offered by the store or otherwise, constitutes their full consent and acceptance, while having the legal capacity recognized under Sharia, statutory, and legal requirements, of all provisions and terms of this Agreement. It also confirms their commitment to comply with its rules and provisions.
This Agreement applies to all forms of transactions between the consumer and the store. It becomes effective and legally binding once you accept it and begin registering with the store, pursuant to Article 10 of the Saudi Electronic Transactions Law.
Article One – Introduction and Definitions
The above introduction forms an integral part of this Agreement. The following terms and expressions shall have the meanings set out below:
- Store: This term includes all forms of the store operating through the internet, whether through an electronic application, website, or physical commercial establishment.
- Consumer: Any person who engages in e-commerce for the purpose of obtaining products or services provided by the store through its electronic platform.
- Agreement: These Terms and Conditions, which govern and regulate the relationship between the parties to this Agreement.
Article Two – Legal Capacity of the Consumer
- The consumer acknowledges that they have the legal capacity required under Sharia and applicable laws to deal with the store, or that they are at least eighteen (18) years of age.
- The consumer agrees that, in the event of violating this Article, they shall bear the consequences of such violation before third parties.
Article Three – Nature of the Store’s Obligations
- The store’s obligation toward consumers is to provide the requested service or product.
- The store may provide additional services, such as after-sales services or other related services, depending on the nature and type of the service or product requested by the consumer.
Article Four – Rules of Use
- The consumer shall use the store’s electronic platform in accordance with public morals and the laws and regulations applicable in the Kingdom of Saudi Arabia.
- When purchasing a service or product from the store, the consumer shall not use such service or product in any manner that violates public morals or applicable laws and regulations in the Kingdom of Saudi Arabia.
Article Five – Accounts and Registration Obligations
Upon applying for membership in the store as a user, you are required to provide certain information and select a username and confidential password to access the store’s services. By doing so, you agree to the following:
- You are responsible for maintaining the confidentiality of your account information and password, and you agree to immediately notify the store of any unauthorized use of your account or any other breach of your confidential information.
- The store shall under no circumstances be liable for any direct or indirect, material or non-material loss resulting from the disclosure of the consumer’s username or password.
- You agree to use your account or membership personally and are fully responsible for it. If another person uses your account, this shall be considered evidence that you have authorized them to use the store on your behalf and for your account.
- You agree to use the store seriously, honestly, and in good faith.
- You agree to provide true, accurate, current, complete, and lawful information about yourself as required during registration and to update such information whenever it changes or when necessary.
- Our store is committed to treating your personal information and contact details with strict confidentiality.
- If the store determines that you have provided false, inaccurate, outdated, incomplete, unlawful, or otherwise non-compliant information in violation of this Agreement, the store reserves the right to suspend, freeze, or terminate your membership, store account, or platform account, without prejudice to any other rights or lawful remedies available to the store to recover its rights and protect other consumers.
- Failure to comply with any of the above provisions gives the store management the right to suspend or terminate your store account or membership, or prevent you from accessing the store’s services again.
Article Six – Electronic Communications and Official Means of Communication
- The parties agree that official communication may take place through the email address registered on the platform.
- The consumer agrees that all agreements, notices, statements, and other communications provided electronically shall have the same legal effect as their written counterparts and shall constitute valid evidence for satisfying applicable legal and Sharia requirements.
- The consumer agrees that the store management may contact them and notify them of any provisions related to this Agreement or their dealings with the store through general messages sent to all consumers or specific messages directed to selected users.
Article Seven – Amendments to the Terms of Use and Fees
- If any provision or clause of this Agreement is cancelled or becomes unenforceable, such cancellation or unenforceability shall not affect the validity of the remaining provisions, clauses, rules, and terms, which shall remain in force until further notice from the store management.
- This Agreement, as amended from time to time when necessary, constitutes the governing framework, understanding, and agreement between the consumer and the store.
- The store may impose fees on certain consumers depending on the offers, products, or services requested, or any fees or taxes imposed by governmental authorities based on the nature of the product or service.
- The store reserves the right to add, increase, reduce, or deduct any fees or expenses pursuant to the provisions of this Agreement in relation to any consumer, regardless of the reason for their registration.
Article Eight – Payment and Settlement Services
- The store, through its partners, provides payment and settlement services. Payments may be made entirely online through the payment methods available on the store or through any other payment method that the store may make available from time to time.
- The store shall determine the price of any service or product offered through the store in accordance with generally accepted market value.
- The store shall provide invoices, payment receipts, and receipt vouchers for all amounts and revenues arising through the store and shall provide consumers with a purchase invoice for any service or product purchased.
- The store shall apply generally accepted accounting standards within its electronic store in accordance with this Agreement and in a manner that serves applicable legal, economic, commercial, and regulatory interests.
Article Nine – Intellectual Property
- All intellectual property rights related to the store are fully owned by the store, whether such rights existed before or were created after the establishment of this electronic platform.
- The consumer shall respect all intellectual property rights belonging to the store, including the store name, words, trademarks, logos, symbols, designs, and any other content displayed on or associated with the store. All such rights are the exclusive intellectual property of the store.
Article Ten – Store Liability
- The store shall conduct its commercial activities through this electronic platform in a lawful manner and in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia and the provisions of this Agreement.
- The store shall not be liable for claims arising from errors or negligence, whether directly, indirectly, incidentally, or as a result of actions by the consumer or a third party, including shipping companies.
- The Store, its employees, owners, and representatives shall ensure that the product or service offered is lawful, safe, and permitted under the laws and regulations of the Kingdom of Saudi Arabia and is intended for lawful purposes.
Article Eleven – Restriction of Access or Membership
The store may suspend or terminate a consumer’s membership or restrict the consumer’s access to the platform’s services at any time, without prior notice, and for any reason.
Article Twelve – Applicable Law
This Terms of Use Agreement is governed by and construed in accordance with the applicable laws, regulations, and legislation of the Kingdom of Saudi Arabia and is fully subject to the regulations enforced by the competent authorities in the Kingdom of Saudi Arabia.
Article Thirteen – General Provisions
If any provision or clause of these Terms of Use is cancelled or becomes unenforceable, such cancellation or unenforceability shall not affect the validity of the remaining provisions, clauses, and terms, which shall remain in full force and effect until further notice from the store management.
These Terms of Use, which may be amended from time to time as necessary, constitute the agreement, operating framework, understanding, and contractual relationship between the store and the consumer.
Both parties agree that the following shall also be taken into consideration:
- The Arabic language shall be the governing language for interpreting the provisions of this Agreement or in the event it is translated into another language.
- All prices displayed for the store’s services or products may be amended from time to time.
- Any promotional or marketing offers provided by the store are temporary, and the store reserves the right to modify or discontinue such offers at any time.
- The parties shall conduct their dealings in a manner that does not violate Sharia principles or the laws and regulations applicable to the nature of the relationship between the store and the consumer.
- These Terms of Use may only be terminated pursuant to a decision issued by the store management.
